A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without lawful basis.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to answer human smuggling charges, he was held in immigration detention.
In her order, the court pointed out that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
